Appeals to UK Supreme Court

In place of the UK Supreme Court, the Scottish Government proposes that the Inner House of the Court of Session and the High Court of Justiciary sitting as the Court of Criminal Appeal will collectively be Scotland’s Supreme Court. Scottish courts will still refer points of EU law to the European Court of Justice in Luxembourg and people will continue to be able to make an application to the European Court of Human Rights in Strasbourg[1]. Professor Neil Walker, in a report in 2010, stated that a new, self-standing Scottish Supreme Court, with separate procedures for ordinary and constitutional jurisdiction, would offer the optimal arrangement for an independent Scotland [2].
